Revised I-9 Form - Be Sure You Are Using the Current Form
As was reported in prior Newsletters, the Department of Homeland Security has recently revised and updated the I-9 form to be used by employers. The form was revised effective August 7, 2009, and contains an updated list of acceptable documents that employees must present upon hiring. The new form has an expiration date of August 31, 2012 (shown in the upper right hand corner of the form.)
Please note that the new form also bears a note that all documents presented to establish identity and/or ability to work in the U.S. must not be expired. An employer cannot accept expired documents. If a new hire presents expired documents, or does not present proper documentation for the completion of the I-9 form, you cannot continue to retain the employee. The employee has 3 business days from the date of hire to present proper documentation. If none is provided, the employment cannot continue.
