DACA Update: Work Re-Verification Not Required

The State of California’s Labor and Workforce Development Agency (LWDA), has issued a news release following the rescission of the Deferred Action for Childhood Arrivals (DACA) program.

The LWDA has taken the position that employers are not required to undertake an immediate re-verification of any work authorization for a DACA recipient.

Further, the LWDA expressly stated “Any action or attempt by employers to re-investigate or re-verify work authorization documents in order to retaliate against any immigrant worker is unlawful in California.
