The Department of Fair Employment and Housing (DFEH) publishes posters and information sheets that provide employees and employers with information pertaining to their rights and obligations in the workplace. 
The DFEH also publishes several brochures and fact sheets regarding discrimination and harassment in the workplace. The brochures are to be provided to new hires or current employees when applicable.
Required Posters
All California employers, regardless of the number of employees, are required to display the following posters:
  • California Law Prohibits Workplace Discrimination and Harassment. This poster updated in December 2019 is effective 1/1/2020 (DFEH-E07P-ENG).
  • Sexual Harassment. This poster was also updated in December 2019 and is effective 1/1/2020 (DFEH-185P).

Most California employers, depending on the size of the workforce, must also display three other posters, which were updated in December 2019:

  • Rights and Obligations as a Pregnant Employee. This notice applies to businesses with 5 or more employees (DFEH-E09P).
  • Transgender Rights in the Workplace Poster. This poster applies to businesses with 5 or more employees (DFEH-E04P).
  • Family Care and Medical Leave and Pregnancy Disability Leave. This poster applies to businesses with 50 or more employees. (DFEH-100-21) A pamphlet for employees is also available for download (DFEH-E02B-ENG).
Employers must display any poster with a December 2019 date as the posting obligation is not met by prior versions of the posters.
The “California Law Prohibits Workplace Discrimination and Harassment” notice reflects the extension of the deadline for employees to file claims of discrimination, harassment, and/or retaliation with the California Department of Fair Employment and Housing (“DFEH”) from one to three years from the date of the alleged wrongful act. This means that after receiving a Right-To-Sue letter from the DFEH, employees will then have one more year to file a civil action in court. This change took effect January 1, 2020.
