Elkins Employment Law provides executive, supervisory and management level employee training on the following topics:

SEXUAL HARASSMENT, DISCRIMINATION AND RETALIATION AVOIDANCE TRAINING

Supervisor and managerial personnel and non-managerial employees are required to undergo state-mandated interactive training on harassment prevention in the workplace. Elkins Employment Law provides training which meets an employer’s legal obligations including handling complaints, conducting investigation, and seeking to resolve the grievance.

DISABILITIES IN THE WORKPLACE

Employers have an obligation to comply with the disability laws under California and federal law which includes the affirmative obligation to engage in an interactive process with an applicant or employee with a disability and seek to provide a reasonable accommodation. This training will focus on understanding who is covered by the disability protection laws, what are covered disabilities, and what steps are required to comply with the legal requirements.

LEAVES OF ABSENCE, SICK LEAVE AND ATTENDANCE CONCERNS

This program covers the vast array of state and federal leaves of absence laws applicable to California employers with one or more employees. The program topics includes a discussion of the overlap of vacation policies with mandated paid sick leave, Paid Time Off (PTO), Disability leave, including pregnancy, baby bonding, ill family members, and workers’ compensation.

WAGE & HOUR COMPLIANCE

This program will address how to determine who is properly classified as exempt versus non-exempt to avoid claims of “misclassifications,” the strictly enforced rules on meals and rest breaks, overtime considerations, travel time, on-call time, days of rest requirements, paystubs and paydays and the misuse of independent contractor classifications.

SUPERVISOR BEST PRACTICES

This program topics include best practices on Interviewing and Hiring, Documentation and Disciplinary actions, Suspensions and Terminations. Proper personnel practices in these areas are critical in reducing the risk of employment related claims and litigation.
