Currently Labor Code Section 1019 provides protection to employees from “unfair immigration-related practices.”
The new law, AB 2751, expands the definition of “unfair immigration-related practice” to includes threatening to file or filing a false report or complaint with any state or federal agency as a protected activity.
AB 2751 also revises Labor Code Section 1024.6, which prohibits employers from discriminating, retaliating, or taking any adverse action against an employee because the employee updates or attempts to update his/her “personal information.”
Because Section 1024.6 did not originally define “personal information,” this new law clarifies that an employer cannot discriminate or retaliate against an employee who updates his/her personal information based on a lawful change of name, Social Security number, or federal employment authorization document.
