The National Labor Relations Board (“NLRB”) announced that it has again postponed the implementation of the new rule requiring private sector employers who are subject to the National Labor Relations Act (“NLRA”) to post a notice which informs employees of their rights under the NLRA and which details the penalties that could be imposed.
The NLRB decided to postpone implementation as a result of a lawsuit which alleges that the NLRB does not have statutory authority to implement such a rule. The NLRB had already postponed implementation until January 31st because of the litigation.
